Mueller Sports Medicine, Inc. (“Mueller”) has successfully enforced its patent and trademark rights, in Germany and with ongoing litigation in the United Kingdom, against 1000 Mile Sportswear Ltd, d/b/a Ultimate Performance together with its managing director Mr. Jack Galaun (“1000 Mile”).
Mueller sued 1000 Mile in the High Court of Justice, Chancery Division, Intellectual Property Enterprise Court in the United Kingdom for infringement of Mueller’s European patent rights by 1000 Mile’s ULTIMATE PERFORMANCE® knee products marketed and sold in the United Kingdom. Mueller expects to prevail, and to collect both damages and attorney fees from 1000 Mile in this UK lawsuit (which remains pending).
Mueller sued 1000 Mile in District Court in Germany for infringement of Mueller’s European patent rights by 1000 Mile’s ULTIMATE PERFORMANCE® knee products marketed and sold in Germany. Mueller prevailed, and the German court enjoined 1000 Mile from further infringement and awarded Mueller both damages and attorney fees.
